Your use of Friendly Toyz Website (hereinafter referred to as "Website") is governed by the following terms and policies as applicable to the Website and its related services. By mere use of the Website, you shall be contracting with Friendly Toyz and these terms and policies constitute your binding obligations with Friendly Toyz. If you transact on the Website, you shall be subject to the policies that are applicable to the Website for such transactions.

For the purpose of these Terms & Policies, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a subscriber or a buyer on the Website by providing Registration Data using the computer systems or over phone or during marketing events. Friendly Toyz allows the user to surf the Website or making purchases without registering on the Website. The term "We", "Us", "Our" shall mean Friendly Toyz

Website Policy

1. The Website is for your personal and non-commercial use and the information may be downloaded or printed by you solely for that purpose
2. Our Website may contain links to other sites. We are not responsible for the content of other sites
3. Friendly Toyz does not guarantee that the Website will operate continuously or without interruption or be error free. Friendly Toyz may suspend or discontinue any aspect of the Website at any time without being liable for any direct or indirect loss as a result of such action
4. You must ensure that your access to and your use of the Website is not illegal or prohibited by laws which apply to you
5. You are responsible for ensuring that your own computer system meets all relevant technical specifications necessary to use the Website and is compatible with the Website
6. Friendly Toyz is not responsible for any virus, malicious computer code, computer program routine or process or other forms of interference which may damage your own computer system while using the Website

Registration

To avail of and use the Website and its related services, the user will have to register on friendlytoyz.com. As part of the registration process the user agrees to provide Friendly Toyz with current, complete and accurate registration information (the "Registration Data") as prompted to do by the Website and to maintain and update this information as required to keep it current, complete and accurate. If the user provides any information that is untrue, inaccurate, not current or incomplete or Friendly Toyz has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete then Friendly Toyz has the right to indefinitely suspend or terminate your account and refuse to provide you with further access. The user shall be solely responsible for maintaining the confidentiality of the password. The user has to intimate Friendly Toyz immediately of any known or suspected unauthorized use of the account or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of the user's password

Privacy Policy

We may collect personal information when you sign up as a subscriber/customer, place an order, request for a service, ask for some information, provide feedback, purchase a product etc. This information is collected by us in order to provide you with efficient customer service and we shall not disclose it to any third party without your prior permission, unless we are required to do so by law. Occasionally we may solicit additional information from you through the use of optional questionnaires

Termination/Suspension

Friendly Toyz reserves its right to refuse service, restrict, suspend, terminate the user's account; Terminate this agreement; Terminate or suspend your access to the Website; Move, or remove any product or service that is available on or through the Website; Deactivate or delete your accounts and all related information and files in your account; Establish general practices and limits concerning use of the Website at any time, in its sole discretion with or without cause, and with or without any prior notice for any violation of the terms and policies. Upon such termination or suspension, the user ceases to have any right forthwith to use friendlytoyz.com. Once the user's registration or the services are terminated, cancelled or suspended, any data that the user has stored on the Website may not be retrieved later

Communications

When you share your contact data or personal information with us, whether online while using the website, through email communication or during offline interaction, we may use this information to send emails or text messages or use any other mode of communication. We will not sell this data or share it with a third party, unless required by law. If you do not want to receive email or text messages from us, please communicate this to us via email/text message or can use the unsubscribe option in our emailers. Kindly note that unsubscribing from one medium does not automatically lead to unsubscription from the other

Intellectual Property Copyright

All content included on the Website and delivered to subscribers/customers as part of the service, including item(s), text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of Friendly Toyz, or its suppliers and is protected by the Indian and International copyright laws. Content shall not be reproduced or used without express written permission from Friendly Toyz, or its suppliers. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the Website, not to insert any code or product or manipulate the content of the Website in any way that affects the user experience, and not to use any data mining, data gathering or extraction method. Friendly Toyz reserves the right to terminate your Subscription hereunder if Friendly Toyz, in its sole and absolute discretion, believes that you are in violation of this paragraph, such violations including the photo copying of item(s) rented to you by us or the copying or other unauthorized use of our proprietary content. Friendly Toyz does not promote, foster or condone the photocopying of item(s) or any other infringing activity

Trademarks

"Friendly Toyz" is a trademark of Friendly Toyz. The Friendly Toyz logo, www.friendlytoyz.com, are trademarks or service marks of Friendly Toyz. The Website, including but not limited to its graphics, logos, page headers, button icons, scripts and service names constitute trade dress of Friendly Toyz. The trademarks, service marks and trade dress of Friendly Toyz may not be used or reproduced without prior written approval from Friendly Toyz, and may not be used in connection with any product or service that is not affiliated with Friendly Toyz, in any manner that is likely to cause confusion among customers, in any manner that dilutes the rights of Friendly Toyz, or in any manner that disparages or discredits Friendly Toyz. Other trademarks that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Friendly Toyz. Any images of persons or personalities contained on the Website are not an indication or endorsement of Friendly Toyz or any particular product or our service unless otherwise indicated

Dealings with Franchisee

In cities where we have franchisee presence, the local service transactions will be dealt by the franchisee directly. The franchisee will take full responsibility of ensuring optimal delivery and quality of service. Friendly Toyz guides its franchisees with standard processes and ensures implementation through regular checks and audits. While customers can communicate to Friendly Toyz and seek intervention in case of a service dispute with a franchisee, but we can't be held legally responsible for services being offered by the franchisee

Changes To Terms & Policies

Friendly Toyz reserves the right to make changes to the Terms & Policies, and recommends that you visit it often. If we make material changes to the Terms & Policies, we will notify you by posting them here

Applicable law

This site is created and controlled by Friendly Toyz. The laws of India shall apply and courts in Haryana shall have jurisdiction in respect of all the terms, conditions, policies and disclaimers

Terms & Policies - Toys As A Service

Delivery schedule

The toys are exchanged weekly or as per the indicated minimum holding period. The day of the week will be fixed by us and will depend on the area you are located in. If you want your delivery rescheduled for whatever reason, we will endeavour to accommodate but cannot provide any guarantee that it shall be done. During the subscription period should you decide to not avail of deliveries for a specific week for whatever reason, and you intimate us in advance about the service postponement, your unused service will be carried forward. If we do not receive a request for service postponement atleast 2 days in advance, your unused service cannot be carried forward and will be deemed to have lapsed. A failed delivery (if you are not at home at the time of your scheduled delivery) will be treated as a retention. It will be accounted for in the same way as if you were taking a new item for the coming week and will be counted towards your weekly entitlement

Payment of subscription, upgrade and renewal

Friendly Toyz offers payment only via Cash on Delivery (CoD) for Weekly toy service. You are required to make payments as soon as your subscription falls due. Friendly Toyz may remind you for payment over phone or email as and when it falls due. You may also upgrade your subscription to a higher plan anytime. In case of a downgrade in plan, the remaining amount will be prorated and adjusted against the new plan selected by you. Our prices may change from time to time. We will keep our Website updated to the extent possible. When an order is placed, it will be executed at the price confirmed prior to shipment. The subscribers are requested to keep themselves updated on any changes in price, services, terms and conditions etc on the Website from time to time

Wishlist creation

Wishlist creation is mandatory if you want to get toys as per your own choice. For more details, please refer FAQ section

Retention of Item(s) Beyond The Minimum Holding Period

You may request for the retention of any item(s) beyond the minimum holding period by intimating Friendly Toyz atleast 2 days prior to the scheduled return. The minimum extension period is 1 week and multiples thereafter. A retention will be accounted for in the same way as if you were taking a new item for the coming week and will be counted towards your weekly entitlement. If you do not intimate us about the toy retention in advance, then Friendly Toyz will be entitled to take back the item(s)

Damage or loss

All items delivered to you under subscription are delivered for a specific time period only and are the property of Friendly Toyz. All item(s) sent to you are thoroughly checked for good condition prior to dispatch. Upon receipt of the item(s), you must ensure that the same is in good condition. Any anomaly, if found, must be reported to our Toyman. Failure to check and/or report the same will be construed as your having received an item in good condition. Once we receive the item(s) back, our staff at the centre will check it to ensure they are received in satisfactory condition. In the event of an item(s) being damaged, we shall intimate you within 3 business days after the receipt of item(s). The determination of an item being "damaged" will be at the sole discretion of Friendly Toyz. Depending on the extent of damage/loss caused, an amount shall be deducted from your Security Deposit which will have to be topped up by you on or before your next due delivery in order to enjoy uninterrupted services. Some guidelines for deduction against toy damage or loss:
  • 1. Regular wear and tear while usage is acceptable
  • 2. Loss/damage of Instruction sheet, Pawns, Dice, Cards etc. - Rs 25 will be charged per item lost/damaged
  • 3. Loss/damage of Game Book, Puzzle piece, Book page or any other integral part of a toy - Cost of full item will be charged
  • 4. Total loss/damage of item(s) - Friendly Toyz is entitled to recover an amount equivalent to the MRP of the item from the subscriber

Cancellation/Termination Of Subscription

If any subscriber decides to cancel his/her subscription, he/she may do so by intimating us over email. Unused subscription may be refunded at our sole discretion. Friendly Toyz reserves the right to terminate / cancel your subscription at its sole discretion without providing any reason whatsoever

Refund Of Security Deposit

After termination / cancellation of your subscription, the security deposit shall be returned within 7 working days after receipt of all items in the possession of the subscriber, in satisfactory condition

Product descriptions

Friendly Toyz and its affiliates attempt to be as accurate as possible. However, Friendly Toyz does not warrant that product descriptions or other contents of this Website are accurate, complete, reliable, current, or error-free. If a product offered by Friendly Toyz is not as described, you may return it in unused condition at the time of delivery

All terms and policies relating to Weekly toy service apply as it is to Weekly book service

Big toys on rent

Each toy in the big toys on rent section has a separate security deposit and a separate rental fee. Ordering big toys work like a standalone order for which the payment has to be made at the time of delivery via Cash on Delivery. The security is refunded back at the time of pick up. For big toy retention beyond the minimum holding period, the rental fee will be pro-rated for the extension period and adjusted from the security deposit amount. All other conditions applicable to Weekly toy service apply for Big toys on rent

Play Zone for Parties

  1. 1. The play zone area as defined on the website is an approximation (in sqft./m2) and may vary slightly from the actual set up area.
  2. 2. Logistics charges are charged on actuals (including packaging and handling charges) and will be borne by the customer. The charges can vary depending on the distance between point of origin and the venue. No promotional offer will be applicable on logistics charges.
  3. 3. A booking will be considered confirmed only after minimum 50% advance payment of the total amount (Security deposit + Logistics charges + Service fee). The balance payment needs to be made on the day of the event 'before' the set up.
  4. 4. A tentative booking can be superseded by a confirmed booking at any point of time. However, the customer holding a tentative booking will be intimated and given priority to confirm the booking within 24 hours.
  5. 5. The operational set up will be available at the venue for a minimum standard duration of 4 hours. Additional charges will apply in case of extension as per the rate chart.
  6. 6. Friendly Toyz reserves the right to deduct charges against any toy damage and/or extended hour(s) from the refundable security deposit amount at the time of final settlement.
  7. 7. For cancellation within 7 days of the event, cancellation charges of 50% of service fee will be levied. For cancellation between 8-21 days of the event, cancellation charges of 25% of service fee will be levied. For cancellation before 21 days of the event, no cancellation charges will be levied

Terms & Policies - Customized Wallpapers

Order Confirmation/Cancellation

An order will be considered as confirmed only upon advance receipt of 50% of the total amount by us. After making the advance payment towards customized wallpaper purchase, the order cannot be cancelled as our production is initiated immediately upon receipt of your advance

Shipping & Delivery

Orders are shipped within 7 working days or as per the delivery date agreed at the time of order confirmation. We are not liable for any delay in delivery by the courier company/postal authorities and only guarantee to hand over the consignment to the courier company/postal authorities within the stipulated time as above. Friendly Toyz shall not be liable for any prolonged delay/non-delivery of purchased goods in the event of flood, fire, wars, acts of God or any other cause that is beyond the control of Friendly Toyz.

Delivery of all orders will be to the address specified by you at the time of placing the order. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost towards re-delivery shall be claimed from the user placing the order.

If at the time of receipt of your order, you find your order packaging to be open, damaged or tampered with, we strongly suggest that you do not accept your order. In such cases you must ask the courier company/ postal authorities to take the order back and inform us immediately within 24 hours about the same by sending an email to contact@friendlytoyz.com or calling us at +91 8800 100 400

Wallpaper Design/Dimension

If you find that the design of the wallpaper delivered to you does not match the website catalogue or the final design approved by you over email (in case of customized designs), you must inform us about the discrepancy by sending an email to contact@friendlytoyz.com or calling us at +91 8800 100 400 immediately upon receiving the wallpaper (maximum within of 2 days of receipt of wallpaper and before installation), so that we can take corrective action.

If you are following the DIY procedure for installation or taking the aid of a 3rd party applicator and the dimensions of the wallpaper delivered to you match the dimensions provided by you to us for printing but do not match the actual dimensions of the wall, Friendly Toyz will not be liable in that case. Any additional costs involved in rectifying the wallpaper will be borne by you

DIY Installation

We take responsibility for supplying the product perfectly cut/packed as ordered by our client. We do not accept responsibility for DIY (Do It Yourself) installation problems or for mistakes in cutting, gluing or fixing by you

Terms & Policies - Return Gifts

Shipping and Delivery

Delivery of all orders will be to the address specified by you at the time of placing the order. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost towards re-delivery shall be claimed from the user placing the order.

The Shipment /Delivery time of upto 7 days for regular delivery and 48 hours for express delivery is only an approximate lead time (not accounting for unforeseen delays) within which we shall try and deliver the goods. Friendly Toyz shall not be liable for any prolonged delay/non-delivery of purchased goods in the event of flood, fire, wars, acts of God or any other cause that is beyond the control of Friendly Toyz.

Product Warranty

All return gift products sold through friendlytoyz.com are covered under their respective manufacturer's warranty or guarantee policy. Friendly Toyz does not provide any additional warranty or guarantee for the products sold through its platform friendlytoyz.com and is not liable for any breach of contract by the product manufacturer with the end customer

Order Cancellation

Cancellation, on user's request, may not be allowed, and is subject to the sole discretion of Friendly Toyz

Terms & Policies - Talent Workshops

Workshop Content

Friendly Toyz ties up with experts/professionals and only organizes workshops from time to time for the benefit of parents and is in no way liable for the content of the workshops

Booking & Cancellation

As there are limited seats available on a first cum first serve basis for every workshop, the workshop fee has to be paid in advance to confirm your seat(s). A tentative booking does not guarantee seat availability for a workshop.

Post confirmation, booking cancellation will not be entertained and the fee will not be refunded. You may transfer your registration in the name of another candidate who is not already registered for that workshop by emailing us at contact@friendlytoyz.com or calling us at +91 8800 100 400
